Article 1: General Provisions

 

The e-commerce website of Old Red Barn  a private limited with registered office at Scheppersstraat 21, 2200 Herentals, VAT BE 0542 853 075 RPR Turnhout, (hereinafter " Old Red Barn " ) offers its customers the ability to produce from her shop to buy online.
 

General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ( "Customer"). Placing an order through the online store of Old Red Barn implies that the Customer has consulted Terms and explicitly accepts the applicability of these Conditions to the exclusion of all other conditions. Article 3: Offers

Old Red Barn is entitled to refuse, due to a serious failure of the Customer relating to the order or any other order or agreement to which the client is involved.

 
Article 5: Delivery and implementation of the agreement

 
Items ordered from this shop are available in all countries of the European Union.

 
The delivery is done by presenting the shipment to the Belgian Post.

 
Unless otherwise agreed, the goods are delivered to the residence of the Customer within 30 days of receipt of the order.

 
Any visible damage and / or qualitative deficiency of an article or other failure in the delivery must be reported to Old Red Barn immediately by the Customer.

 
The risk of loss or damage shall pass to the customer as he (or a designated third party, other than the carrier) the goods received. However, the risk is already transferred to the Customer upon delivery to the carrier if the carrier of the customer has received the goods to be transported.

 
Article 6: Retention of property

 

The delivered articles remain until the time of full payment by the Customer, the exclusive property of Old Red Barn.

 
Article 7: Right of withdrawal

 
The provisions of this Article shall apply only to customers in their capacity as consumer articles online purchased at Old Red Barn.

 
The Customer has the right to withdraw from the contract within 14 days without giving any reason.

 
The withdrawal period shall expire 14 days after the day on which the Customer or a third party designated by the customer, which is not the carrier, gets physical possession of the goods.

 
To exercise the right of withdrawal, the customer needs to notify Old Red Barn (address: Scheppersstraat 21, 2200 Herentals, email: info@oldredbarn.be) by an unequivocal statement (eg in writing by post or email) to notify his decision to withdraw. The Customer may use the attached model withdrawal form, but is not obliged to do so.

 
In order to comply with the withdrawal period, the Customer must send its notice before the withdrawal period has expired.

 
The Customer must return the goods without delay, but in any event no later than 14 calendar days after the date on which he communicated his decision to withdraw from the contract at Old Red Barn returned or handed over to Old Red Barn, Scheppersstraat 21, 2200 Herentals. The Customer is in time if he sends back the goods before the deadline of 14 calendar days has elapsed.

 
The direct cost of returning the goods shall be borne by the Customer.

 
If the returned product is in any way impaired, Old Red Barn reserves the right to keep the Client liable for each diminuation of the value of the goods resulting from the use of the goods by the customer.

 
Only items that are in their original packaging along with all accessories, manuals and invoice or proof of purchase can be returned.

 
If the Customer cancels the agreement, Old Red Barn will refund all payments received up to that point of the Customer, excluding the shipping costs, within a maximum of 14 calendar days after the customer has informed Old Red Barn of the decision to withdraw. For sales Old Red Barn may withhold the reimbursement until he has received the goods or until the Customer has demonstrated that he has returned to the goods, whichever is first.

The Customer will not be charged for a reimbursement.

 
Article 8: Guarantee

 
Under the Act of 21 September 2004 on the protection of consumers in consumer sales, the consumer has legal rights. This statutory warranty applies from the date of purchase (in case of delivery to) to the first owner.

 
In order to invoke the warranty, the Customer must provide proof of purchase. Customers are advised to keep their original packaging of goods.

 

For items purchased online and delivered to the Customer at home, the Customer shall contact Old Red Barn before the Customer returns the product at its expense to Old Red Barn.

 

When determining a defect, the Customer must inform Old Red Barn as soon as possible. In all cases every defect must be reported by the Customer within two months of its purchase.
 
The warranty does not apply to defects that arise as a result of accident, neglect, falls, use of the product contrary to purpose for which it was designed, non-compliance with the operating instructions or manual adjustments or modifications to the article, rough use, poor maintenance, or any other abnormal or improper use.
 
Neither does it apply to items with a shorter life, or wear and tear items.

 

Defects that manifest themselves after a period of 6 months from date of purchase or delivery, shall be deemed to be not a hidden defect.

 
The warranty is not transferable .

Article 10: Penalties for non-payment

Without prejudice to the exercise of any other rights of Old Red Barn features, the customer in the event of non-payment or late payment from the date of the breach of law and without notice, an interest of 10% per annum on the unpaid amount. Furthermore, the Customer shall automatically and without notice a lump sum compensation of 10% of the amount in question, with a minimum of 25 per invoice.

 

Notwithstanding the foregoing, Old Red Barn reserves the right to take back not (fully) paid items.

Article 15: Evidence

 

The Customer agrees that electronic communications and backups can serve as evidence.

 
Article 16: Applicable law - Jurisdiction

 

The Belgian law is applicable, except for the provisions of international law concerning applicable law and the Rome I Regulation on the International Sale of Goods. In case of disputes, the courts of Turnhout, Belgium have exclusive jurisdiction.
